Expression in Canada

Are forms of expression in contradiction with Canada freedom and has legislation been thoroughly tested against scrutiny
Astounding that an individual could face criminal prosecution for expression that comes out of his or her voice or what he or she expresses. Some could argue singing or poetry or visual art could be determined offensive enough to be considered hate speech?
While recognizing definition of freedom varies from cultural perspective and urban and rural definitions of what may be deemed offensive should also be taken to consideration.
While police powers seem to grow we recognize individual sub-culture define freedom differently within context of Canada.
Differentiating hate speech from legitimate forms of expression are motivation and mitigating circumstances
